Of course, the driver is responsible for its vehicle, its trailer and loads.
In matter of goods trailers (espacially for the small models with racks) and of boat trailers, better is worth to choose a model with a safety margin.
Rien à déclarer ? The problems of the prices or of the insurance are nothing compared to the obvious risks of the overloads, road controls or accidents.
The good faith of a driver showing up the documentation of its boat will never be retained. It is always the responsability of the driver to make sure the load is secure and there is no overload.
The only valid insurance is to check the total weight (trailer plus load) on a public weighing system and to keep the receipt.
To avoid serious problems of overloads, it is necessary to be convinced that :
a . for the trailer

The payload mentioned on the plate manufacturer and the compliance certificate is often only indicative…
The true payload is the difference between the gross weight*and the real unladen weight.
However :
- the ability of approving trailers "frame only" (without equipment or with minimum equipment common to several versions),

- the assembly of optional equipment such as spare wheel, electric winch, specific supports, etc…
makes the final payload lower than the official one.
So it should be checked that the announced payload take well account of the complete equipment of the trailer.

Examples of weight of optional equipment:

- wheel 145/70x13 = 12 kg ; wheel 185x14 = 18 kg;
- electric winch = 12 kg ; complete floor (car transporter) = 98 kg;
- double height of rack/trailer 2.50 X 1.40 = 77 kg.

b ) boat

If the weight of the motor bikes or the cars is perfectly known , it should be admitted that the weights of the machines or the boats:

- are often underestimated (theoretical weight "engineering and design department"), even false or not updated after modifications,

- take into account neither additional accessories, limp with tools, full tanks for the engines… neither balconies, anchors or additionnal chains, neither engine of help, and even less the luggage in the boat!

CAUTION:

To determine the needed payload of a boat trailer, it is compulsory :
- to envisage a margin of error from 15 to 20 % for the theoretical boat weight,
- to count the weight of the additional equipment,
- to estimate the fuelling and the possible luggages.
